Aspiria Recruit have an exciting opportunity for an experienced Solicitor/Chartered Legal Executive, specialising in contentious trusts and probate, to join a modern-thinking, Legal 500 law firm in either their Kingsbridge or Plymouth office. The successful candidate will be working closely with the Head of the Dispute Resolution department to help them grow and develop this area. You will be responsible for managing a caseload of predominantly contentious trusts and probate work, whilst supervising the work of more junior members of the team within this field. There is significant scope for career progression within the role and to help build and expand the firm’s contentious probate offering. The ideal candidate will have 3 years' PQE or those with equivalent experience.
Skills and experience sought:
- Experience of contentious trusts and probate caseload, including some or all of:
- Claims under the Inheritance (Provision for Family and Dependants) Act 1975;
- Will validity challenges concerning testamentary capacity, undue influence and fraudulent calumny;
- Mutual wills disputes;
- Claims over property concerning constructive / resulting trusts and proprietary estoppel;
- Disputes between beneficiaries and executors/trustees concerning the administration of wills and trusts;
- Claims brought under TOLATA 1996
- Have experience and knowledge of civil procedure within the High Court, particularly within the Chancery Division;
- Have enthusiasm and vision for the continued growth of the firm’s contentious trusts and probate offering.
